Scope
These terms apply to every order placed on shop.noireaudio.com. They are accepted before each payment, by ticking the box in the purchase window.
Products and licence
Each purchase grants a perpetual licence to use the software bought, with no subscription. It is attached to your NOIRE AUDIO account.
- The software can be active on three computers at a time. A computer is removed from your account, which frees its place.
- A bundle grants each piece of software it includes. NOIRE Complete Bundle also includes the software NOIRE AUDIO publishes later.
- NOIRE Check is free with an account, under the same licence terms.
- The licence is personal and non-exclusive: it may not be resold or transferred without the seller’s written consent. The software remains the property of NOIRE AUDIO.
Requirements: 64-bit Windows and a VST3-compatible host (NOIRE Console and NOIRE Mastering Suite also run as standalone applications). Activation needs an internet connection, then an online check at least every 30 days.
Prices
Prices are shown in euros, all taxes included, in the shop at the time of the order. VAT regime: VAT charged, or the mention “VAT not applicable, art. 293 B of the French General Tax Code”
Order and payment
Orders are placed from a NOIRE AUDIO account: choice of the product, acceptance of these terms and request for immediate access, then card payment on Stripe’s secure page. Card details are processed by Stripe; NOIRE AUDIO never has access to them. An e-mail confirms the order with a link to the receipt.
Access to the software
As soon as the payment is confirmed, the software joins your account. It is downloaded and installed with NOIRE Central, available from your account, then activated by signing in with the same address.
Right of withdrawal
The software is digital content supplied without a tangible medium. Before paying, you expressly ask for immediate access and acknowledge that you thereby lose your right of withdrawal: this right therefore cannot be exercised, under article L221-28, 13°, of the French Consumer Code. Without this request, the order cannot be placed. The confirmation e-mail repeats it.
Warranties
The legal warranties of the French Consumer Code for digital content, including the legal warranty of conformity, apply. In case of a defect, write to customer service (see “Seller”). If a payment is refunded, the corresponding licence is removed from your account.
Liability
Keep a copy of your projects before installing or updating software. The seller’s liability is limited to what the law allows; this never excludes the legal warranties owed to consumers.
Personal data
Account and order data are processed as described in the privacy policy.
Mediation and disputes
If you have a problem, write to customer service first. If the answer does not satisfy you, you can refer the matter free of charge to the consumer mediator: name and contact details of the consumer mediator. These terms are governed by French law.
